Service Overview

e-Evidence Legal Representative (Article 3(1)(b))

Do you operate a non-EU online platform, communications or hosting service with EU users?

The e-Evidence Directive (Directive (EU) 2023/1544) creates a cross-border framework for judicial authorities across the EU to request electronic evidence held by service providers. Non-EU providers of electronic communications services, information society services, internet domain name and IP numbering services, and certain online platforms that fall within scope will be required to designate a legal representative established in the EU to receive and manage data production and preservation orders. The Directive applies from 18 August 2026.

What this service covers

Our focus

A structured EU legal representative for cross-border criminal evidence requests

Lionheart's e-Evidence service is designed for non-EU service providers that need a legal representative in Ireland to receive and manage production and preservation orders from EU judicial authorities. We provide an Ireland-based legal foothold with documented intake, logging and escalation procedures.

Designed for operational readiness, not just formal designation

These requests can be sensitive, deadline-driven and legally consequential. Lionheart acts as the formal EU addressee for in-scope orders, ensuring they are received, tracked and escalated to your internal legal or investigations team under a controlled process.

A natural fit for platform, hosting and infrastructure providers

For organisations already managing GDPR, DSA, TCOR or NIS2 obligations, the e-Evidence representative role should not sit in isolation. Lionheart works with clients to help them align these parallel channels under one coherent governance structure.

Our services include

  • Formal designation as your EU legal representative for e-Evidence purposes
  • Ireland-based point of contact for receipt of production and preservation orders
  • Logging, validation and prompt forwarding of incoming orders to your internal legal or investigations team

Defined escalation procedures for urgent and time-bound requests

Language handling and communication routing support

Regular activity reporting and correspondence records on request

Legal basis: Article 3(1)(b), Directive (EU) 2023/1544 (applies from 18 August 2026 for providers already offering services in the Union on 18 February 2026)
